Practice Areas and Experience
Mr. Gebauer has more than 17 years of experience as a litigator primarily in the areas of civil and commercial litigation. Mr. Gebauer has worked for international law firms and local law firms, and understands both how to scale complexity to the needs of a more complicated case, while avoiding excessive legal fees on potentially less-complex cases. His clients include a variety of commercial businesses and their management; partners, directors, officers, shareholders, members and managers in “business divorce” litigation; beneficiaries, trustees, and devisees in probate, trust, and estate litigation; owners, lenders, general contractors and subcontractors in construction defect or other construction disputes; and medical and other professionals involved in administrative proceedings before state licensing and disciplinary boards. Mr. Gebauer has also practiced in the area of antitrust litigation.

 

Mr. Gebauer has tried a number of cases in federal courts and state courts. Example representations include:

  • Favorable arbitration award in defense of medical practice in “business divorce” case in arbitration hearing where departing partner claiming approximately $1 million was due to a departing owner under a buy-sell agreement.
  • Favorable judgment at trial in defense of general contractor in construction defect case—plaintiff was required to pay attorney fees of defendants due to lack of substantial justification for filing the case.

  • Favorable settlement of “business divorce” case where shareholder had earlier attempted to compete with existing business.

Mr. Gebauer speaks Mandarin Chinese, Japanese, Spanish, French, and Dutch, to various degrees of fluency, and enjoys learning about new cultures.
